Please read these Terms of Service carefully before using Qaval Host services.
Effective Date: June 11, 20261. Introduction
Welcome to Qaval Host ("Company," "we," "our," "us"). These Terms of Service ("Terms") govern your access to and use of our website (qavalhost.com), hosting services, domain registration, SSL certificates, and all related products and services (collectively, the "Services").
By registering for, accessing, or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use our Services.
2. Service Description
Qaval Host provides the following core services:
- Web Hosting — Shared, WordPress, and scalable hosting solutions with NVMe SSD storage, cPanel control panel, and 99.9% uptime guarantee.
- Domain Registration & Transfer — Registration, renewal, and transfer of domain names across 500+ TLDs.
- SSL Certificates — Free and premium SSL/TLS certificates for website security.
- Email Hosting — Professional email services included with hosting plans.
- Website Migration — Free assisted migration for new customers.
Specific features, resource allocations, and limitations are detailed in your selected plan and are subject to the Acceptable Use Policy outlined below.
3. Account Registration & Responsibilities
3.1 Account Creation
To use our Services, you must register for an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate and complete.
3.2 Account Security
You are responsible for:
- Maintaining the confidentiality of your account credentials (username, password, and any API keys).
- All activities that occur under your account, whether authorized by you or not.
- Promptly notifying us of any unauthorized access or security breach at support@qavalhost.com.
3.3 Eligibility
You must be at least 18 years of age or the legal age of majority in your jurisdiction to use our Services. By registering, you represent that you meet this requirement.
3.4 Accurate Information
For domain registrations, you must provide valid contact information as required by ICANN. Providing false or misleading WHOIS data may result in domain suspension or termination without refund.
4. Acceptable Use Policy (AUP)
You agree not to use the Services for any unlawful or prohibited activities, including but not limited to:
- Hosting, distributing, or linking to material that infringes on intellectual property rights of others.
- Sending unsolicited bulk email (spam), phishing emails, or engaging in any form of email abuse.
- Hosting malware, viruses, trojans, botnets, or any malicious software.
- Engaging in port scanning, DDoS attacks, or any form of network abuse or unauthorized access attempts.
- Hosting adult or pornographic content.
- Operating cryptocurrency mining software on shared hosting infrastructure.
- Using excessive server resources that negatively impact other users on shared environments.
- Hosting or promoting hate speech, violence, harassment, or discrimination.
- Violating export control laws or sanctions regulations of Nigeria, the United States, or applicable jurisdictions.
We reserve the right to investigate any suspected violation and to suspend or terminate any account found in breach of this AUP without prior notice. We may also report illegal activities to law enforcement authorities.
5. Payment Terms
5.1 Pricing & Fees
All prices are listed in Nigerian Naira (₦) unless otherwise stated. Prices are subject to change with 30 days' notice. Promotional pricing applies only to the initial term and renews at standard rates unless otherwise specified.
5.2 Billing Cycle
Services are billed on a monthly or annual basis as selected during checkout. You authorize us to charge your chosen payment method on each renewal date unless you cancel prior to renewal.
5.3 Currency & Taxes
Prices displayed do not include applicable taxes, VAT, or duties unless explicitly included. You are responsible for all taxes levied on your use of the Services.
5.4 Late Payments
Accounts with overdue invoices may be suspended after a grace period of 7 days. Services will be terminated 30 days after non-payment if no arrangement is made. A reconnection fee may apply for reactivating suspended accounts.
6. Refund Policy
6.1 30-Day Money-Back Guarantee
We offer a 30-day money-back guarantee on all web hosting and managed WordPress plans. If you are not completely satisfied within the first 30 days of service, you may request a full refund of hosting fees paid.
6.2 Non-Refundable Items
The following are non-refundable:
- Domain name registrations, renewals, and transfers.
- SSL certificate purchases.
- Add-on services and third-party software licenses.
- Setup fees, migration fees, or custom development charges.
- Renewal payments after the initial 30-day period.
- Accounts terminated for AUP violations.
6.3 Refund Requests
To request a refund, contact our billing team at support@qavalhost.com or submit a ticket through the client area. Refunds are processed within 7–14 business days to the original payment method.
7. Service Availability & Support
7.1 Uptime Guarantee
We guarantee 99.9% network uptime on our hosting infrastructure. If we fail to meet this SLA in any given month, you may request a credit of 5% of your monthly hosting fee for each 30 minutes of downtime, up to 100% of your monthly fee.
7.2 Support
We provide 24/7 technical support via ticket system and email. Response times vary by issue severity but we aim to acknowledge all tickets within 4 hours. Support is limited to issues directly related to our hosting infrastructure and does not include website development, coding, or third-party software troubleshooting.
7.3 Scheduled Maintenance
Scheduled maintenance will be announced at least 48 hours in advance via our status page or email notification. Emergency maintenance may be performed without prior notice when necessary to protect the integrity or security of the network.
8. Intellectual Property
8.1 Your Content
You retain all ownership rights to the content, data, and intellectual property you upload or host on our Services. We claim no ownership over your content.
8.2 License to Host
By using our Services, you grant us a limited, non-exclusive license to host, store, and transmit your content solely as necessary to provide the Services.
8.3 DMCA & Copyright
We respond to valid DMCA takedown notices. If you believe your copyrighted work has been infringed on a site hosted by us, submit a notice to abuse@qavalhost.com.
9. Limitation of Liability
To the maximum extent permitted by applicable law:
- No Indirect Damages: Qaval Host shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses.
- Liability Cap: Our total liability for any claim arising out of or relating to these Terms or the Services shall not exceed the total amount paid by you to Qaval Host in the 12 months preceding the event giving rise to the claim.
- No Warranty: The Services are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
10. Termination
10.1 Termination by You
You may cancel your Services at any time through the client area or by contacting support. Cancellation takes effect at the end of the current billing cycle. No pro-rated refunds are provided for cancellations after the 30-day money-back period.
10.2 Termination by Us
We may suspend or terminate your account and access to the Services at any time, with or without cause, including but not limited to:
- Violation of these Terms or the Acceptable Use Policy.
- Non-payment of fees.
- Fraudulent activity or chargebacks.
- Request by law enforcement or regulatory authority.
10.3 Effect of Termination
Upon termination, your right to access the Services ceases immediately. You are responsible for backing up your data prior to termination. We may delete all data associated with your account 30 days after termination.
11. Data Protection & Backup
While we maintain backup systems, you are solely responsible for maintaining your own backups of all data hosted on our servers. We are not liable for any data loss regardless of cause. We process personal data in accordance with our Privacy Policy.
12. Indemnification
You agree to indemnify, defend, and hold harmless Qaval Host and its officers, directors, employees, and affiliates from and against any claims, damages, liabilities, losses, costs, and expenses (including reasonable attorneys' fees) arising out of:
- Your use of the Services.
- Your violation of these Terms.
- Your content infringing on the rights of a third party.
13. Third-Party Services
Our Services may integrate with or link to third-party websites, applications, or services. Qaval Host does not endorse, monitor, or assume responsibility for third-party services. Your use of third-party services is governed by their respective terms and policies.
14. Changes to These Terms
We reserve the right to modify these Terms at any time. Material changes will be communicated via email or a notice on our website at least 30 days before taking effect. Your continued use of the Services after such modifications constitutes acceptance of the revised Terms.
15. Governing Law & Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the Federal Republic of Nigeria, without regard to conflict of law principles. Any dispute arising out of or relating to these Terms shall be resolved through good faith negotiation. If negotiation fails, disputes shall be submitted to binding arbitration in Lagos, Nigeria.
